Last year, in Universal Health Services v. United States ex rel. Escobar, the US Supreme Court issued an important decision for the healthcare industry that purported to clarify the standard for materiality and implied certification under the False Claims Act. In the year since, however, courts have adopted different interpretations.

Join us for our next Fast Break with John Cosgriff as we explore what Escobar means and discuss recent cases on when a company’s representation is material to the government’s decision to pay a claim.

Topics will include:

  • Background on the implied certification theory
  • Government’s response to Escobar
  • Defendants’ responses to Escobar
  • Implications for healthcare companies
