Independent Contractor Misclassification Issues and the 2013 Post-Election Risk Landscape

January 10, 2013
12:00 PM - 01:00 PM

Please join Morgan Lewis for a one-hour webinar in which presenters from our Labor and Employment and Employee Benefits/Tax Practices will address the following questions:

  • What is the 2013 risk outlook for entities that use independent contractors?
  • What are the consequences of misclassification?
  • How should nontraditional employment relationships be structured to enhance independent contractor status?
  • How should entities document nontraditional employment relationships?
  • How can the risks of existing independent contractor relationships be minimized?

In recent years, employers have increasingly turned to agencies, temporary workers, and independent contractors to fill staffing needs. While these nontraditional employment relationships provide certain benefits, they also present a minefield of employment law risks.

With the continuation of the Obama administration, the number of independent contractors who will be found to be employees under a host of applicable laws will likely increase. In addition, employers can expect increased scrutiny from various state and federal governmental entities that have an interest in the classification of workers.
