The prospect of corporate tax reform raises the possibility that the United States will consider adopting “patent box” or “IP box” legislation to create a special tax regime for income from intellectual property as part of the Internal Revenue Code. IP box tax regimes have been conditionally blessed by the Organization for Economic Cooperation and Development (OECD), and have been adopted by many countries as a way of encouraging domestic ownership of IP and domestic R&D activities.
