Ensuring the enforceability of contracts in the energy industry can be challenging. International arbitration is an attractive dispute resolution mechanism. At this roundtable event, our presenters will discuss lessons learned from recent experience and will provide practical suggestions on developing effective strategies for using international arbitration as a dispute resolution tool.

Questions discussed will include:

  • Which arbitral regimes should be considered for Europe, Middle East, and Africa (EMEA) arbitrations?
  • How can arbitration clauses be attacked in the UK, and how can enforceable arbitration clauses be drafted for EMEA disputes?
  • What are the strategy considerations in light of the new ICC rules and the proposed new LCIA rules? Are multiparty and consolidation now achievable?
  • What are the strategy considerations when deciding whether and how to use the new AAA, ICDR, and CPR rules?
