Morgan Lewis–TMI Joint Seminar: Doing Business Online, Through Mobile Apps, and with Connected Devices – Limiting Liability, New Privacy Laws, and Litigation Updates

Morgan Lewis partners Carla Oakley, Motonori Araki, and Mitsuyoshi Saito and associate Jitsuro Morishita as well as lawyers from TMI Associates will present in a three-part seminar on “Doing Business Online, Through Mobile Apps, and with Connected Devices – Limiting Liability, New Privacy Laws, and Litigation Updates.” 

Most companies have websites, conduct business online or through mobile apps, and advertise through social media. Many consumer products now are connected to the internet, ranging from smartwatches to household appliances to vehicles. At the same time, companies are gathering massive amounts of e-data that are key to their businesses, raising privacy and cybersecurity concerns. With the new technologies and expanded data collection comes a new array of legal challenges and new laws, addressing a wide range of consumer issues of concern to all businesses. 

In Part I and Part III of this seminar, lawyers from Morgan Lewis in California and Tokyo will discuss a variety of issues relevant to conducting business online or through mobile apps, the Internet of Things, social media and other forms of online marketing, including practical steps for businesses to limit their liability and reduce the risk of claims. This seminar will provide litigation updates relevant to these areas of business, and address issues of particular concern to Japanese companies conducting business in the United States – directly or through US subsidiaries – including challenges with US litigation in federal and state courts. In addition, the seminar will discuss the recently enacted California Privacy Protection Act of 2018, which will require companies to implement substantial changes along the lines of the GDPR, but with some significant differences, as well as other new privacy laws and litigation updates. 

Furthermore, in Part II, lawyers from TMI will discuss various legal issues upon usage of data, including latest amendment of Copyright Act, Unfair Competition Prevention Act, and related guidelines of IoT businesses.
