Setting the stage for what promises to be a blockbuster environmental case, the U.S. Supreme Court on December 6 agreed to hear a challenge to a lower court decision allowing plaintiffs to maintain in federal court a public nuisance lawsuit against energy companies that operate fossil-fuel-fired electric generating plants, based on the companies' alleged emissions of greenhouse gases that are claimed to contribute to climate change. The Supreme Court's decision in this closely watched case could have a dramatic impact on the energy industry and ripple through other major industries as well. This webinar will review the major issues in the case and discuss how it fits with other greenhouse gas-related litigation and regulation.

Ronald J. Tenpas co-chairs Morgan Lewis's Environmental and Climate Change Practices and is also active in the firm's Appellate Practice. Prior to joining Morgan Lewis, Mr. Tenpas served as the Assistant Attorney General (AAG) for the Environment and Natural Resources Division of the U.S. Department of Justice. That work included participating in numerous briefs before the Supreme Court on various environmental issues. He began his legal career as a judicial law clerk to U.S. Supreme Court Chief Justice William H. Rehnquist.
