Tax professionals often analyze moving ownership or rights to IP to foreign affiliates or sometimes back to the US. Moving the ownership of IP raises concerns about protecting IP. We’ll talk about the differences between tax-IP and “real” IP and what in-house professionals need to know and consider in order to defend and protect their IP post-transfer and the inherent tension between the valuations of IP for tax purposes and for all other purposes.
