Two of the most high profile Supreme Court decisions of the recently concluded term affect employer-sponsored health plans. King v. Burwell upheld the Patient Protection and Affordable Care Act’s tax credits available to individuals who purchase insurance on the government-created exchanges. In Obergefell v. Hodges, the Supreme Court held that the fundamental right to marry is a constitutionally protected right and required states to issue marriage licenses to same-sex couples and to recognize valid same-sex marriage from other jurisdictions.
