On June 30, 2015, the US Department of Labor (DOL) announced its proposed rule to update the Fair Labor Standards Act’s “white collar” exemption tests. As many employers are aware, the tests were last updated in 2004, and the goal of this update is to strengthen the tests so more employees are entitled to overtime. The main focus of the proposal is to update the minimum salary levels required, in part, to satisfy the exemption tests.
