Colin B. Heideman
Colin Heideman is a patent litigator who defends technology and medical device companies. In US district courts, at the Federal Circuit, and before the Patent Trial and Appeals Board (PTAB), Colin guides clients through complex, high-stakes litigation matters. As lead counsel, Colin has successfully steered clients through dozens of inter partes review (IPR) proceedings.
Colin regularly speaks at industry conferences about patent litigation, strategy, and PTAB proceedings. Colin co-founded the Canadian American Bar Association and formerly served as its vice president and secretary-treasurer. He is a member of the Federal Circuit Bar Association and the Washington State Patent Lawyers Association (WSPLA), where he previously served as chair of the WSPLA Litigation Committee.
In his free time, Colin serves as a volunteer coach of the Sno-King Amateur Hockey Association.
Before joining Morgan Lewis, Colin was a partner at a national IP law firm.
- Represented Amazon in IPR proceedings before the PTAB on three patents related to video annotation playback; PTAB invalidated all claims and Federal Circuit affirmed
- Represented Amazon in patent litigation in the Northern District of New York related to natural language processing; obtained summary judgment of invalidity
- Represented Amazon in patent litigation over Echo smart speakers; prevailed on non-infringement at the Federal Circuit following jury trial in the Eastern District of Texas
- Represented Amazon in nine-patent case involving smart speaker signal processing; transferred case to Northern District of California and obtained stay pending IPRs, which were instituted; case settled
- Represented a portfolio medical technology company in District of Massachusetts patent litigation and IPRs involving knee replacement surgical instruments; secured PTAB decisions invalidating four asserted patents; case settled
- Represented Amazon in Western District of Texas patent litigation involving eight patents on client-server networking and remote application execution; all related IPRs instituted
- Represented Amazon in District of Delaware patent litigation on seven patents covering recommendations, checkout, decryption, ads, and OS updates; all patents invalidated as patent-ineligible; Federal Circuit affirmed
- Represented Amazon in IPRs on seven asserted patents; PTAB invalidated all claims as anticipated or obvious; Federal Circuit affirmed under Rule 36
- Represented defendants in District of Delaware litigation over controlled-release metformin formulations; achieved favorable case-dispositive settlement
- Represented defendant in design patent case in Western District of Washington; obtained early dismissal and declaration of noninfringement; judgment affirmed on appeal
- Represented plaintiff in declaratory judgment action in District of Colorado on technology disabling mobile devices in vehicles; secured favorable covenant not to sue
- Represented plaintiff in Western District of Washington trademark case; achieved favorable settlement
- Represented defendants in Southern District of New York patent litigation on fenofibrate compositions; secured favorable settlement
- Represented plaintiff in Central District of California breach of contract and inventorship case on thermal semiconductor patents; won summary judgment and full trial victory; awarded $5.7 million in attorney fees
- Represented plaintiff in Southern District of California patent litigation on mycotoxin-binding compositions; obtained summary judgment on infringement and counterclaims; secured favorable settlement
