F. Jackson Stoddard

Additionally, Jack represents and advises clients on regulatory issues related to the development of electric power and transmission projects, interconnection agreements, power purchase agreements, energy efficiency services agreements, and agreements related to purchase and sale of renewable energy credits and greenhouse gas allowances. He has represented companies of all sizes across the energy industry, including renewable and conventional generators, fuel cell manufacturers, cogenerators, electric storage developers, petroleum refineries, large industrial entities, oil and natural gas pipelines, and both investor-owned and municipal utilities.

Prior to joining Morgan Lewis, Jack was counsel in another global law firm’s energy practice. He also previously practiced at a national law firm where he represented clients on energy-related matters, as well as water and telecommunications issues. Before entering private practice, Jack was staff counsel at the CPUC, serving as a legal and energy advisor to multiple commissioners. While at the Commission, he also served as lead counsel on implementation of the California Renewable Portfolio Standard (RPS) program and implementation of California's greenhouse gas policies, including AB 32.

• Represent DCR Transmission, LLC in application for a certificate of public convenience and necessity for a 500 kV Ten West Link transmission line
• Represent Nexant, Inc. in proceedings before the CPUC related to utility energy efficiency programs
• Represented a solar project developer in a dispute with CAISO regarding forfeiture of an interconnection security bond
• Represented a solar project developer in obtaining extension of commercial online dates under a CAISO interconnection agreement and related tariff modifications
• Represented consumer products companies in connection with California Energy Commission enforcement actions
• As lead counsel, represented a large petroleum refiner/marketer before the CPUC and CARB in successfully obtaining monetary relief for greenhouse gas (GHG) compliance costs resulting from discriminatory treatment of purchased power under the California Cap-and-Trade regulation
• As lead counsel, represented University of California in obtaining transition relief for GHG compliance costs related to the treatment of cogeneration under the California Cap-and-Trade regulation
• Represented telecommunications providers in the resolution of CPUC Safety and Enforcement Division investigations concerning alleged violations of requirements related to registration and remittance of surcharges
• Served as regulatory counsel in a civil contract action brought by Tesoro Marketing & Refining Company against Pacific Gas & Electric Company for a power outage at Tesoro’s Golden Eagle Refinery
• Served as regulatory counsel to a 400 MW independent power producer in the arbitration of a contract dispute, and related CPUC and CARB regulatory proceedings, concerning the allocation of GHG compliance costs under power purchase agreement
