Sweeping Enforcement of Worker Classification Issues Webcast

2010年3月23日
03:00 午後 - 04:00 午後 Eastern Daylight Time

Please join Morgan Lewis's Anne Marie Estevez, Miriam Fisher, and David Fuller for this webcast, which will highlight internal review and best practices, as well as best practices for dealing with governmental scrutiny and handling claims and litigation.

In a move that will impact thousands of businesses, cash-strapped federal and state authorities have launched high-profile initiatives to scrutinize and enhance enforcement of worker classification (employees vs. independent contractors).

  • Authorities have invested millions of dollars to "crack down" on misclassifications
  • Misclassification can result in multimillion-dollar class and collective actions, audits, civil and criminal penalties—and the plaintiffs' bar is filing new cases weekly
  • The IRS estimates that approximately 15% of employers misclassify their workers, resulting in $2.7 billion annually in uncollected taxes
  • In February, the IRS launched its largest audit initiative in 30 years, targeting 6,000 employers with the goal of closing the tax gap and increasing future compliance
  • The IRS will coordinate the results of its initiative with the states that have beefed up applicable penalties
