NJSBA Fall CLEfest – Labor and Employment Law Track

Labor and Employment partner Rich Rosenblatt will be speaking at the New Jersey State Bar Association’s Fall Labor and Employment Law Track on a panel titled “Substance Use Disorder and Employment Law.” 

With the opioid crisis reaching epidemic proportions, all employers, including law firms, are affected. This panel will discuss how to address substance use disorder matters along with types of policies and monitoring mechanisms an employer should have in place. 

Topics will include:

  • New Jersey’s new marijuana posture;
  • Implementing substance use policies and monitoring mechanisms;
  • Recognizing the warning signs of addiction;
  • What an employer may do to approach an employee suspected of current substance use;
  • When an employer may require testing and when doing so could create legal exposure;
  • What is and what is not protected under the ADA;
  • How the ADA defines current user of illegal drugs;
  • Whether the current user of illegal substances exception applies under the LAD;
  • Can enrolling in a treatment program provide ADA or LAD protection;
  • Leaves, reasonable accommodation and return to work;
  • Disability and perception of disability discrimination; and
  • The law firm and other professional settings – malpractice and ethical issues

CLE Credit

NJ CLE: This program has been approved for 7.2 credits (50 minute hour), including 1.0 ethics/professionalism credits (Ethics are only for PM session)

Trial Attorney Certification: 3.6 civil credits pending (AM session Only)

PA CLE: 5.5 substantive and 0.5 ethics credits pending ($24 fee – separate check payable to NJICLE must be submitted at the end of the program)  (Ethics are only for PM session)

NY CLE (Transitional & Non-transitional): 6.0 professional practice and 1.0 ethics credits (Ethics are only for PM session)
