On October 17, 2020, the Standing Committee of China's National People's Congress (NPC) passed the Export Control Law of the People's Republic of China (ECL), which will become effective on December 1, 2020. The ECL is China’s first comprehensive and unified export control regime.

On September 19, 2020, China’s MOFCOM released the Provisions on the Unreliable Entities List (UEL). The Provisions establish the framework of a regime under which punitive measures may be imposed on designated foreign entities—including companies, other organizations, or individuals—that “endanger China's national sovereignty, security or development interests” and are “violating the principles of normal market transactions, interrupting normal transactions with Chinese entities, or adopting discriminatory measures against Chinese entities, seriously damaging the legal rights of the entity.”

These changes bring new challenges for many businesses, especially multinational companies doing business in China or with Chinese business partners.
