Antitrust enforcers around the world are forecasting vigorous antitrust enforcement in labor markets, particularly with respect to so-called “no poach” agreements (no-hire or nonsolicitation agreements), wage-fixing agreements, and unlawful information sharing among employers. In December 2021, the US Department of Justice and US Federal Trade Commission held a joint workshop discussing efforts to promote competitive labor markets and worker mobility, with the promise to make labor market competition a continued enforcement priority. Outside the United States, enforcers have opened labor market investigations and/or issued new guidelines or statements on enforcement in this area.
