DOL Passes 'Apolitical' ESG Rule Poised to Endure, Ignites

Partner Lance Dial spoke with Ignites about the US Department of Labor’s (DOL’s) final rule regarding the consideration of environmental, social, and governance (ESG) factors in choosing retirement plan investments. Lance said the final rule has “appropriate regulatory neutrality,” following two key changes the DOL made to its October 2021 proposal—the removal of the requirement for plan fiduciaries to consider ESG factors in favor of language merely permitting plan fiduciaries to do so and doing away with examples of ESG considerations plan fiduciaries could make.
