Does ‘Leniency’ Inspire Companies to Report Wrongdoing?, Daily Journal

Partners Zane Memeger and Mark Krotoski were quoted in a Daily Journal article about the US Department of Justice’s (DOJ’s) updated leniency model meant to encourage companies to report wrongdoing. Zane said attorneys handling defense for companies involved in government investigations can now chart the best path forward with a better understanding of DOJ expectations about voluntary disclosure.

Mark noted that “[t]ransparency and predictability are key elements for using these self-disclosure programs.”

“Periodic updates to ensure that incentives are clear and costs minimized are part of the process to ensure the leniency program is operating effectively,” he said.
