Pity the DOJ Lawyers (For Now) in Transgender Military Ban Showdown, Am Law Litigation Daily

In an article by Morgan Lewis partner Susan Baker Manning is quoted from an amicus brief she filed on behalf of high-ranking military healthcare professionals about the preliminary injunction against the Department of Defense’s 2018 policy that bans transgender people from completing military service. The article quotes the brief, saying, “the DoD Report fails to show that banning transgender people from military service is rationally, much less substantially, related to the government’s asserted interests in military readiness, unit cohesion, or cost savings.”
