Morgan Lewis partner Mark Krotoski was interviewed by Corporate Counsel for an article about what in-house leaders and executives should know before and after a data breach is suspected during an M&A deal. Mark is quoted throughout the article and noted that state and federal regulators are placing emphasis on when a company discloses a data breach. “You have to manage it [disclosure] by prioritizing which ones have the first deadlines and then hopefully you can learn everything about the incident so you can notify everyone in all the jurisdictions at the same time,” said Mark, referring to the varying notification requirements and deadlines among states and the federal government.
