Data Transfer, Enforcement Questions Linger Post-Brexit, Law360

Partner Pulina Whittaker was quoted in a Law360 article about the Trade and Cooperation Agreement, which maintains an arrangement for data transfer between companies in the European Union and the United Kingdom. The agreement outlines a six-month grace period during which personal data can flow both ways. Discussing how businesses can prepare for updating their existing transfer agreements in the near future, Pulina said that businesses should "take into account the legal framework of the importing country, particularly with respect to surveillance measures, to ensure that the transferred data will be adequately protected. Once the clauses are finalized, companies will have a year to replace their existing contracts.”
