Partner Susan Harthill was quoted by HR Magazine discussing how the Biden administration’s decision to lift certain limits on the US Department of Labor issuing subregulatory guidance will provide more flexibility for the agency. Discussing the practicalities of subregulatory guidance, Susan told HR Magazine that “it is helpful to stakeholders and is less time-consuming than rulemaking.” Susan went on to say that its unlikely that the new administration will continue to issue opinion letters, which were previously used to provide legal guidance for employers and employees.
