US Cartel Fines Sink in 2021 Despite Global Surge, GCR

GCR featured findings from Morgan Lewis’s 2021 Global Cartel Enforcement Report, which noted that global cartel fines increased by 229% last year, while the United States experienced a significant drop in penalties. Partner Mark Krotoski, co-author of the report, told the publication that the Department of Justice’s (DOJ’s) involvement in global cartel cases has declined in recent years as the agency focuses resources domestically, which may be impacting the Antitrust Division’s ability to secure a greater number of fines. “We just haven’t seen as many international investigations recently,” said Mark, adding that more global cartel enforcement from the DOJ is expected in the future.
