The US Department of Justice (DOJ) released its report on the False Claims Act (FCA) judgments and settlements in fiscal year 2021, which revealed that 90% of all FCA recoveries—more than $5 billion out of an estimated $5.6 billion—come from healthcare industry cases overseen by the US Department of Health and Human Services. Speaking with Law360 on the key takeaways from the DOJ’s report, partner Kathleen McDermott said, “It just looks like one industry is a convenient target for noncompliance. The data tell you that they can’t possibly be focusing in any significant way on the other industries.”
