PHILADELPHIA, October 25, 2022: Dana Baiocco, who most recently served as one of five commissioners of the US Consumer Product Safety Commission (CPSC), joins Morgan Lewis as a partner resident in Philadelphia. Dana, who has 20 years of private law firm experience as a litigator, returns to private practice to focus on high-stakes litigation and trials involving mass torts, consumer and industrial products, and medical devices, as well as counseling on building robust compliance programs and reporting obligations for consumer products.
“Dana is a key strategic addition to our firm, where she will leverage her government and trial experience to assist our clients across multiple industries,” said Firm Chair Jami McKeon. “These are complex times for companies in the consumer product space, and our clients depend on us for elite representation and advice from trusted counsel as credentialed as Dana.”
The CPSC has jurisdiction over tens of thousands of consumer products, and Dana as a commissioner contributed to the overall policy agenda and rulemaking proceedings while working to promote product safety and advance consumer safety. She also oversaw or authorized investigations and litigation—evaluating and initiating enforcement actions and civil penalty proceedings both independently and in conjunction with the US Department of Justice. Additionally, Dana served as the CPSC’s designated principal member on the US Border Interagency Executive Council, a working group of more than 50 federal agencies with import and export responsibilities.
In private practice, Dana forged a reputation as a talented trial lawyer and trusted advisor for strategic business advice. She represented clients in high-stakes trials in federal, state, and international courts—from product recalls to antitrust, construction, and bankruptcy matters.
“As we continue to strengthen the breadth and depth of our litigation capabilities, Dana draws on an impressive history of trial success and creative strategic advice that will be of inestimable value to our clients,” said J. Gordon Cooney, Jr., leader of Morgan Lewis’s global litigation practice. “In addition, she brings outstanding experience and perspective to help our clients evaluate and strengthen their consumer product compliance programs.”
