Partner Giovanna Cinelli was quoted in a Foreign Investment Watch article about some federal lawmakers' call for reforms at the US Department of Commerce that would include more funding for the Bureau of Industry and Security (BIS). Giovanna said the “reform” asked for by the House Select Committee on the Chinese Communist Party is likely related to the sometimes-conflicting objectives of the Commerce Department.
“Commerce is focused on both encouraging legitimate trade, while also managing the national security issues with export controls, import requirements (such as tariffs, anti-dumping and CVD matters), and participation in CFIUS,” Giovanna said, adding that it can be challenging to meet both objectives. “The Committee may be focused on the steps Commerce is taking, has taken, or should take to move more clearly towards its national security mission, given how much it controls from an export perspective.”
