DOL Expands FLSA Overtime Exemption for Commissioned Retail, Service Workers, HR Dive

Morgan Lewis partner Susan Harthill was quoted in an HR Drive article about the US Department of Labor’s (DOL’s) decision to expand an overtime exemption rule under Fair Labor Standards Act (FLSA) Section 7(i). In the article, she discusses the implications of the expansion. "The criteria to qualify for the exemption remain the same," said Susan. "What has changed is that DOL and the courts are no longer bound by the categorical lists — DOL can take a fresh look at any establishment and apply the existing criteria, taking into account new business realities and the way that services are delivered in the modern world."
