Labor Department Issues Final Rule on Calculating 'Regular Rate' of Pay, SHRM

Morgan Lewis partner Susan Harthill discussed the US Department of Labor’s (DOL’s) final rule on "regular rate" of pay calculations in an SHRM article. In the article, Susan discussed the uncertainty around the definition between discretionary and nondiscretionary bonuses. She also noted that while the DOL has clarified its position on a number of benefits, employers should still check relevant state laws because they may have stricter overtime restrictions.
