WASHINGTON, D.C., May 11, 2011: Morgan Lewis today announced that Donna Lee Yesner and Stephen E. Ruscus—who focus on government healthcare contracts—have joined the firm as partners in its FDA and Healthcare practice, resident in Washington. Ms. Yesner is the co-chair of the Healthcare Contracting Committee of the ABA Public Contracts Section.

Ms. Yesner is well known for having won a case in the U.S. Court of Appeals on behalf of the Coalition for Government Procurement Healthcare Committee regarding unlawful Tricare rebate claims. The Coalition's victory saved the pharmaceutical industry more than $1 billion. She focuses her practice on public healthcare and government contracts, with an emphasis on pharmaceutical and medical device public sector business. She has experience in the acquisition and reimbursement of federal healthcare supplies and services, particularly Department of Veterans Affairs, Department of Defense, and Department of Health and Human Services; compliance with laws and regulations governing the Medicaid, Medicare, Tricare, and the 340B drug discount programs, debarment and public policy affecting these programs; and healthcare fraud.
Mr. Ruscus focuses his practice on public healthcare, government contracts, and litigation. His practice entails counseling, audits and investigations in connection with government acquisition and reimbursement of federal healthcare supplies and services, with an emphasis on pharmaceuticals and medical devices. His counseling practice includes assisting clients with a wide range of pharmaceutical pricing issues and compliance with obligations regarding state Medicaid, the centers for Medicare and Medicaid services, and the U.S. Department of Veterans Affairs drug programs. In addition, Mr. Ruscus counsels clients on a variety of complex government contract law issues, including federal procurement of commercial items and services, resolution of government contracts disputes, as well as federal debarment and suspension. He has experience in litigation before the U.S. Court of Federal Claims, the U.S. Courts of Appeals, and the Armed Services Board of Contract Appeals, and in bid protests before the GAO.
