Morgan Lewis, Orrick Advise EnergySolutions on La Crosse Boiling Water Reactor Decommissioning

Thursday, June 2, 2016

HOUSTON, June 2, 2016: Morgan Lewis and Orrick represented global nuclear services company EnergySolutions in the decommissioning of the La Crosse Boiling Water Reactor (LACBWR) site located in Genoa, Wisconsin, owned by Dairyland Power Cooperative.

LACBWR was originally built as a joint project with the federal Atomic Energy Corporation, and operated from 1967 to 1987. The closing of the transaction follows the Nuclear Regulatory Commission’s approval in late May of the transfer of the license for the facility from Dairyland Power Cooperative to LaCrosseSolutions, a subsidiary of EnergySolutions. Under the terms of the decommissioning agreement, LaCrosseSolutions will dismantle LACBWR and remove its existing buildings and structures from the LACBWR site.

The Morgan Lewis team advising on the transaction was led by partner John Matthews (Washington, DC). Houston partner Chris Amandes advised on environmental matters and Philadelphia partner Paul Gordon advised on tax matters. Orrick’s team was comprised of partner Jonathan Ayre, an energy and infrastructure partner in the firm’s Houston office, and partner Darrell Thomas, who advised on real estate matters.
