Policy, But What Now: The GCR Section 5 Roundtable, Global Competition Review

Now that the Federal Trade Commission has published its long-awaited guidance on when and how it will challenge anti-competitive conduct that falls outside of the traditional antitrust laws, the question remains: What does this mean for the agency’s enforcement agenda, and what light does the guidance shed on when the agency will choose to bring a section 5 case.
