PTAB Time Bar Decisions Can’t Be Appealed, SCOTUS Rules, Intellectual Property Magazine

Morgan Lewis partner Sanjay Murthy commented on the US Supreme Court’s ruling in the long-awaited Thryv, Inc v Click-To-Call Technologies litigation. The court held that US Patent and Trademark Office’s Patent Trial and Appeal Board (PTAB) determinations for inter partes reviews (IPR) cannot be appealed after finding that a one-year time bar does not apply. Commenting on the verdict in Intellectual Property Magazine, Sanjay suggested that the ruling “will likely lower the cost of Federal Circuit appeals by streamlining issues.”
