Predictive Coding: What is it? What's Next? Why is it Important?

July 26, 2013

Morgan Lewis partner Tess Blair was a panelist for the program "Predictive Coding: What is it? What's Next? Why is it Important?" at the The Masters Series for Legal Professionals.

This panel examined the basics of predictive coding. What is "automated review"? How can processes and procedures be implemented to create a reasonable and defensible automated review protocol? Judge Peck's recent opinion in Da Silva Moore v. Publicis Groupe & MSL Group was the first written opinion to approve the use of computer-assisted review. A second "automated review" case, Kleen Products v. Packaging Corp. of America, is pending in Federal Court in Illinois. Panelists examined both cases, discussed key takeaways, and offered predictions for the future of automated review.
