Third Circuit Affirms EPA’s Issuance of a Multi-State Clean Water Act TMDL Framework for Reducing Pollution to the Chesapeake Bay, Environmental Liability, Enforcement & Penalties Reporter

The Third Circuit Court of Appeals has upheld the U.S. Environmental Protection Agency's (EPA) comprehensive pollution-reduction framework for the Chesapeake Bay (Bay) watershed, holding that EPA's Total Maximum Daily Load (TMDL) for nitrogen, phosphorous, and sediment in the watershed was a legitimate policy choice within EPA's statutory authority.
