WM Morrison Supermarkets Plc v Various Claimants, Intellectual Property Magazine

Morgan Lewis partner Pulina Whitaker authored an article for Intellectual Property Magazine about a decision where the UK Supreme Court ruled that employers are not liable for the actions of their rogue employees. In the article, Paulina notes that this decision overturned one from a lower court that employers could be vicariously liable for an employee’s misuse of personal data that was previously under the employer’s control. WM Morrison Supermarkets Plc v Various Claimants is the first instance of a group litigation order being used in a data breach claim in the United Kingdom.
