Florida Justices Affirm Access to Adverse Medical Incident Documents, Report on Patient Privacy

On October 26, 2017, the Florida Supreme Court ruled that a 2004 Florida constitution amendment (“Amendment 7”) grants patients broad access to adverse incident reports from medical providers, including reports made in preparation for medical malpractice litigation. In 2011, patient Amber Edwards sued Bartow Regional Medical Center (“Bartow”) and Dr. Larry D. Thomas for medical malpractice following a procedure where Dr. Thomas inadvertently cut Edward’s common bile duct.
