Florida Justices Rule That Florida Citizens Have a Right to Privacy After Death, Report on Patient Privacy

On November 9, 2017, the Florida Supreme Court struck down a 2013 medical malpractice law which, once a plaintiff provided mandatory notice of intent to file suit, allowed potential defense counsel to meet with a patient’s other treating doctors without the plaintiff’s attorneys present. The plaintiff in the lawsuit, Emma Weaver, argued that such ex parte communications lead to potential violations of patient privacy.
