Forestalling Forties Follies, Trusts & Estates

Morgan Lewis associate Emily Pickering co-authored a feature article on estate planning and taxation in the June 2019 issue of Trusts & Estates. The article discusses general powers of appointment (GPOA) established by trusts created before October 22, 1942. The article noted that these GPOAs are given special treatment by the Internal Revenue Code and were recently addressed in private letter rulings. “The exercise, releases and lapses [of these powers] can create unexpected and innovative opportunities for estate planners,” said the article.
