The New Albany Shale lies under much of the Illinois Basin and has been producing small amounts of gas since 1858. The advent of horizontal drilling allowed for a dramatic increase in the volume of gas that can be extracted.

The Illinois Oil and Gas Act regulates oil and gas drilling in Illinois, including permitting, well-spacing, and well-plugging, and is enforced by the Oil and Gas Division of the Office of Mines and Minerals of the Illinois Department of Natural Resources, established in 1944. Recent amendments to the Act, effective July 27, 2011, marked significant and expansive changes to the oil and gas drilling regulatory scheme in Illinois.
