New Wave of Class Action Litigation Against Non-Profits: ERISA’s Church Plan Exemption, Bender’s California Labor and Employment Bulletin

Within a two-month span last spring, different plaintiffs represented by the same law firms launched a targeted attack against religiously-affiliated nonprofits. Plaintiffs filed five nearly-identical putative class actions against non-profit Catholic hospital associations. The actions, if successful, could have a wide-ranging and potentially significant effects, not only on the entities directly involved in the lawsuits, but also on other religiously-affiliated nonprofits throughout the United States.
