Survey of the Law of Cyberspace: Intellectual Property Cases 2008, The Business Lawyer Vol. 65 No. 1

This year's survey of intellectual property cases is an exciting collection of cases that have captured the public interest.

Of the cases surveyed, two have had writs of certiorari granted by the U.S. Supreme Court and one is being appealed to the U.S. Court of Appeals for the Federal Circuit en banc. Online commerce takes center stage as the various courts wrestle with the necessary length of duration of a copy for copyright infringement, the use of keywords as trademarks, and the patentability of business methods.
