Time To Prepare For New US-UK Data Sharing Rules, Law360

Morgan Lewis partners Omar Shah, and Mark Krotoski and associate Jessica Rogers authored an article for Law360 about a landmark US-UK Bilateral Data Access Agreement. The agreement, expected to take effect in July, will allow both countries to access electronic data for the purpose of aiding criminal investigations.

The authors explain how the bilateral agreement was designed to address the slow mutual legal assistance treaty (MLAT) process and therefore will speed up investigations and prosecutions. They conclude that the agreement “will serve an important role as a model for other countries to enter into similar agreements under the CLOUD Act and the COPO Act”.
