Bansri Mehta McCarthy
Bansri McCarthy counsels clients on complex eDiscovery, information governance, and legal technology issues, with a particular focus on the practical and defensible use of AI in litigation and discovery. She develops discovery and data strategies that account not only for technical requirements, but also for litigation objectives, evidentiary considerations, privilege, privacy, proportionality, cost, and risk. She advises clients across a range of industries, including financial services, technology, insurance, aviation, life sciences, and media.
Bansri advises on the full information life cycle, including preservation and collection strategy, complex and emerging data sources, electronically stored information (ESI) protocols and protective orders, technology-assisted review, search and analytics, privilege, document production, and information governance. She frequently works with litigation teams on matters in which technical data issues intersect with substantive legal strategy, including questions involving spoliation, authentication, privilege, cross-border disclosure, and the development of a defensible record for potential discovery disputes. She also counsels organizations on information-governance and legal-operations issues, including enterprise technology migrations and legal hold systems.
A significant focus of Bansri's practice is helping clients evaluate and deploy generative AI (GenAI) and other advanced discovery technologies in ways that are efficient, practical, and defensible. She has designed and implemented AI-enabled workflows for document review, privilege analysis, large-scale mobile-data analysis, validation of existing coding, and organization and analysis of complex case files. She also advises clients and legal teams on workflow design, validation, human oversight, privilege, and other legal and defensibility considerations associated with AI use.
Bansri is a frequent speaker and author on eDiscovery, information governance, artificial intelligence, and privilege. She regularly presents to clients and industry audiences on practical AI adoption and emerging discovery issues and also trains lawyers and legal technology professionals on the strategic and defensibility considerations associated with advanced discovery workflows.
- Advised on discovery strategy across a portfolio of related US and UK aviation litigations, developing coordinated approaches to preservation, supplemental collections, cross-border disclosure, protective-order requirements, database architecture, review, and production while accounting for differing claims, defenses, privacy requirements, and disclosure regimes
- Led ESI strategy in highly contentious litigation involving review of more than one million documents and production of more than 200,000 documents on a compressed court-ordered schedule, including technology-assisted review (TAR) strategy, ESI and protective-order negotiations, privilege issues, letter briefing, and preparation for court conferences
- Designed and deployed AI-enabled discovery workflows in complex litigation, including combining GenAI with TAR, using AI to validate historical coding, supporting privilege analysis and privilege-log preparation, and incorporating appropriate validation and human oversight
- Used GenAI to analyze a large volume of mobile data for a financial information services client in lieu of conventional full-population review, leading the client's legal operations team to seek further guidance regarding broader adoption of AI by outside counsel
- Advised on high-profile litigation involving complex data-authentication and preservation issues, including allegations concerning potentially fabricated electronic communications and the opposing party's use of AI in court filings; developed preservation, device-collection, ESI, and protective-order strategy in light of the associated evidentiary and privacy risks
- Advised on potential spoliation and complex data-custody issues arising from multiple corporate acquisitions, analyzing how device history, chain of custody, privilege, and data mapping affected litigation strategy and the development of a record for potential court intervention
- Counseled a global technology company on information-governance and data-risk considerations associated with an enterprise migration from Microsoft 365 to Google Workspace, including data implications, risk assessment, and benchmarking
- Oversaw a regulatory remediation involving a financial-services client's email-review procedures, managing the vendor and remediation process, preparing the presentation of findings, and presenting those findings directly to the Financial Industry Regulatory Authority
