Understanding litigation at the US International Trade Commission (ITC) under Section 337 of the Tariff Act and the enforcement of powerful ITC exclusion orders by US Customs is critical for technology companies. ITC cases move faster than any other intellectual property (IP) litigation forum in the United States, making it an ideal venue for companies attempting to protect newly developed technology from potentially infringing imports.

For companies named as respondents at the ITC, the risk is enterprise threatening. A win by an IP-holder can lead to an extreme remedy—an order to US Customs and Border Protection to bar the importation of products found to violate Section 337 and to force the exportation or destruction of inventory already in the United States.
