Lawyers Seeing More Activity, Industry Concern Surrounding 1260H List, Export Compliance Daily
15 декабря 2025 г.Export Compliance Daily quoted partners David Plotinsky and Todd Liao, from comments they made during a Morgan Lewis webinar, for an article about how the United States has been adding more entities to the Pentagon’s Chinese military company list.
As David and Todd noted during the webinar, they are seeing a rise in client work involving the 1260H list, which places government contract restrictions on listed entities.
David said that, historically, the list was a “name and shame mechanism,” and so “a lot of companies initially just took the hint and didn’t necessarily challenge it.” However, more companies are now looking to challenge their designation to the list due to the potential impact of the upcoming Biosecure Act.
Todd added that the companies being targeted are “not small companies,” adding that they have “extensive supply relationship and business relationships with US-based companies in a lot of capacities,” which is causing US executives at multinational firms to ask: “What if these companies all of a sudden came on the list? What happens to my contract?”
