Sergio Oehninger co-authored an article for Bloomberg BNA Privacy and Security Law Report examining whether if a record is available online and no one sees it, does it constitute a ‘‘publication’’ for the purpose of insurance coverage. The article looked at a court decision that marked a notable win for policyholders seeking coverage for cybersecurity incidents under commercial general liability (CGL) policies because prior court decisions involving cybersecurity loss had found no ‘‘publication’’ as used in CGL policies.
