Dukes v. Wal-Mart: What Can Employers Expect Next in Employment Class Action Litigation?

Please join Morgan Lewis for an in-depth review of the U.S. Supreme Court's recent decision in Dukes v. Wal-Mart.

Issues to be addressed will include:

  • What are the legal implications of the Dukes decision for pending and future employment discrimination class actions?
  • What can employers expect next from the plaintiffs' class action bar, and how can employers best prepare for the next wave of class action or multiplaintiff litigation that could flow from the Dukes decision?
  • Should employers still be conducting pay and promotion studies? Is there still risk post-Dukes?
  • Will there be an increase in Equal Employment OpportunityCommission (EEOC) pattern and practice litigation because the EEOC is not subject to the class certification requirements addressed in Dukes?
