In recent years, employers have increasingly turned to agencies, temporary workers, and independent contractors to fill staffing needs. While these nontraditional employment relationships provide certain benefits, they also present a minefield of employment law risks.
With the continuation of the Obama administration, the number of independent contractors who will be found to be employees under a host of applicable laws will likely increase. In addition, employers can expect increased scrutiny from various state and federal governmental entities that have an interest in the classification of workers.
