Bid Rigging and Price Fixing

The DOJ’s Antitrust Division, together with the FBI, has launched a widespread investigation into price fixing, big rigging, and other anticompetitive conduct in the automotive parts industry. Following the prosecution of Showa Corporation for anticompetitive conduct back in April 2014, the Assistant Attorney General in charge of the DOJ’s Antitrust Division announced this was the 27th case of fixing the selling of parts to automotive manufacturing companies. Then on April 23rd of this year, an executive for Hitachi Motor Corporation pled guilty to creating an anticompetitive environment in selling parts to several US-based OEMs and was sentenced to serve 15 months in jail. Is anticompetitive conduct in the automotive industry still a top priority for the Antitrust Division’s criminal enforcement division? What are the implications for the auto industry? What are some of the lessons learned from these investigations, and how should auto companies respond to perceived anticompetitive conduct?
