Employer Workplace Rules: The Latest on What’s Lawful and Unlawful Under the NLRA

Partner and former National Labor Relations Board member Harry Johnson reviews the latest guidance on employer rules and policies relevant to nonunion and union employers. Analyzing the US Court of Appeals for the Fifth Circuit’s decision in T-Mobile USA, Inc. v. NLRB, Harry offers insight on the interpretation of the “reasonable employee” standard. He also dissects the Fifth Circuit’s reasoning for its findings that policies on positive work environment, commitment to integrity, and sharing of nonpublic information are lawful and that rules on recording in the workplace are unlawful.
