Andrea Delgadillo Ostrovsky

Andrea Delgadillo Ostrovsky is an experienced trial lawyer who handles a wide variety of civil litigation, government investigations, and employment matters. Andrea’s practice includes representing clients in complex civil disputes, consumer protection litigation, and employment litigation. She also has extensive experience defending businesses and individuals in government enforcement matters, including matters involving the False Claims Act (FCA) and Anti-Kickback Statute (AKS), as well as environmental, securities, healthcare, and government contracting matters.

As a business leader and lawyer, Andrea has held a variety of dynamic roles throughout her career. Prior to joining Morgan Lewis, she was the CEO of a Seattle-based professional services company, guiding the business through a period of tremendous growth and evolution. Andrea also served as the company’s general counsel and COO.

Andrea was a founding partner of Seattle boutique litigation law firm Calfo Eakes & Ostrovsky.

Andrea makes significant community contributions through pro bono work, nonprofit director service, and other volunteer efforts. She currently serves on the board of Forterra, an innovative regional land trust.

White Collar Defense, Whistleblower, and False Claims Act

  • Represented Alaska Native Corporation in pursuit of FCA and breach of contract claims against former business partners; achieved outstanding settlement terms after defeating motion to dismiss; obtained favorable resolution of related DOJ enforcement action
  • Represented real estate syndication firm executive in criminal proceedings arising from sale of billions of dollars of fractional commercial real estate interests
  • Represented multiple government contractors in federal investigations related to alleged false claims, including regarding Small Business Act compliance
  • Represented numerous doctors and healthcare groups in various matters involving FCA, Stark Law, and AKS allegations

Complex Civil Litigation

  • Represented nonprofit housing organization against high-profile negligence claim related to police shooting of resident; achieved full dismissal after arguing motion to dismiss
  • Represented real estate syndication firm executive in multiforum civil proceedings arising from sale of billions of dollars of fractional commercial real estate interests
  • Represented municipality regarding propriety of safety conditions municipality imposed on business licenses; served as lead counsel for administrative hearing where client achieved significant victory

Employment Litigation

  • Represented public defense agency in disability discrimination case brought by public defender; served as co-lead trial counsel and achieved dismissal of all claims after first week of trial
  • Represented prominent attorney accused of sexual harassment and retaliation by staff member; achieved highly favorable settlement at mediation
  • Represented county agency against employment discrimination, retaliation, and failure-to-accommodate claims; served as co-lead counsel at administrative proceeding where achieved favorable result
